Man receives 50 years in prison for child's death

Timothy Moncebiaz, 28, waived his right to a jury trial and pleaded guilty to the felony charge of injury to a child. The punishment range for such a charge is five to 99 years or life in prison. Judge Ken Anderson convicted Moncebiaz and sentenced him to 50 years in prison.
Anderson also made an affirmative finding that Moncebiaz used his hands as a deadly weapon. That finding means Moncebiaz will not be eligible for parole for at least 25 years.
On July 15, 2008, the Williamson County Sheriff's Office began investigating the cause of a severe head injury to Angelica Ubillus, a 3-year-old female child who was being treated at the Dell Children's Medical Center in Austin. The child, who also had a bite mark and bruising over her body, died at the hospital. The investigation focused on Debora DeSilva (date of birth, April 23, 1984), the child's mother, and her new boyfriend - Moncebiaz.
During an interview with WCSO Investigator John Foster, Moncebiaz admitted he was responsible for the injuries to Ubillus, which occurred in and outside his parent's home in north Austin, where he lived. The medical examiner, after conducting an autopsy on Ubillus, concluded that the child died from blunt force injuries to her head.
